Stage 6: 3001 - Death Wise/Elder; In this stage, the dragons become far larger (often up to the size of a medium sized town), and more lazy.

On Friday, the Supreme Court granted partial cert. in the?Assoc. For Molecular Pathology v. Myriad Genetics, Inc., 12-398. ?In other words, the Supreme Court agreed to decide only the first issue presented:
Can human genes be patented?
Myriad Genetics obtained patents for two genes, BRCA1 and BRCA2. ?Mutations of these genes correlate with an increase risk of hereditary breast and ovarian cancer. ?The patent claims include ?every single natural variation of the genes, including those that have not yet been isolated.?
The Association for Molecular Pathology claimed the patent inhibited scientific research and prevented patients from accessing their own genes. ?Further, the Association stated that because gene variation is created naturally.
Myriad claimed that the PTO has long recognized that claims to ?isolated? molecules of DNA reflect human-made, patent-eligible inventions. ?In fact, the PTO has issued over 40,000 patents drawn to DNA-related subject matter.
The District Court invalidated the patent on the grounds the patented genes were not ?markedly different.? ?The District Court held that Myriad did not ?alter its essential characteristic ? its nucleotide sequence that is defined by nature and central to both its biological function within the cell and its utility as a research tool in the lab.?
A divided 2-1 Federal Circuit found these genes were patentable. ?On remand following the decision of Mayo, the divided panel did not change their decision.
Myriad pointed to the lead opinion?s interpretation of Mayo. ?The lead opinion observed that ?[w]hile Mayo and earlier decisions concerning method claim patentability provide valuable insights and illuminate broad, foundational principles, the Supreme Court?s decision in Chakrabarty and Funk Brothers set out the primary framework for deciding the patent eligibility of compositions matter, including isolated DNA molecules.?
The Association pointed to Judge Lourie?s and Judge Bryson?s statements regarding Mayo. ?Judge Lourie stated that Mayo ?clearly ought to apply equally to manifestations of nature (composition claims).? ?Judge Bryson, in his dissenting opinion, interpreted Mayo?s method as asking whether the applicant made an ?inventive? contribution to the product of nature.

Zynga and Facebook just renegotiated a long-term deal the games maker and the social network signed in 2010.Essentially, the deal erases some special privileges Zynga had, putting it on more equal footing with other app developers, while freeing Zynga up to develop games for other platforms.
Of course, there are no other social networks that matter, at least as far as games are concerned. Zynga offers Zynga Poker and a handful of other games on Google+, Yahoo, and MySpace. Activity there, as far as we can tell, is insignificant. The platform Zynga really cares about, besides Facebook, is its own website, Zynga.com.
So what this really lets Zynga do is develop Zynga.com independently from Facebook.
In exchange, Facebook no longer has to guarantee growth targets for Zynga or give Zynga special abilities to promote its games. For the most part, Zynga will now get treated like any other developer. Facebook wanted that because other developers have been doing much, much better than Zynga.
One other thing Zynga gave up was a restriction preventing Facebook from developing its own games.
That's gotten a lot of people thinking Facebook is going to jump right in and compete with Zynga.
We don't think that makes any sense: Facebook CEO Mark Zuckerberg has been pretty outspoken about how his company didn't anticipate that people would want to play games on the social network, and he doesn't think Facebook would be good at coming up with games.
What Facebook is good at, though, is building a platform for games.
That's exactly what Zynga wants to do, too. Zynga.com is a game-focused social network for Zynga's own titles, but Zynga is courting other developers to let it publish their games for them on Zynga's platform?its network of players, its cloud infrastructure, and its payments systems.
Don't forget, Facebook just hired away Zynga's CFO, Dave Wehner, two weeks ago. He's known for his expertise in virtual goods and digital payments?and he's now putting that to work in a finance job at Facebook.

WASHINGTON (AP) ? Vice President Joe Biden on Thursday led a tribute on Capitol Hill to the late GOP Sen. Warren Rudman of New Hampshire, recalling him as "forthright, frugal and fair."
Senate Democratic Leader Harry Reid, Sen. John McCain of Arizona and former Supreme Court Justice David Souter, a close Rudman friend from New Hampshire, were among many friends and former colleagues from both parties at the memorial event.
Rudman, who died Nov. 19 at 82, co-authored a ground-breaking budget balancing law, championed ethics and led a commission that predicted the danger of homeland terrorist attacks before 9/11.
The feisty former New Hampshire attorney general went to the Senate in 1981 with a reputation as a tough prosecutor, and was called on by Senate leaders, and later by presidents of both parties, to tackle tough assignments.
"His honesty could be searing," Biden said, but Rudman also showed deep compassion and faith in the dignity and wisdom of ordinary Americans.
McCain praised Rudman's character, his lack of pretense and his willingness to buck his party when he felt Republicans were wrong.
"Besides being gruff, irascible, blunt and impatient ... Warren Rudman, first and last, was a man of integrity."
Souter saluted the independence and courage of Rudman, a combat veteran of the Korean War.
"There was no one on the face of the earth he was afraid of," Souter said.
Rudman, at the same time, never hated those he disagreed with, said Souter.
"What he'd do instead is stick his hand out," Souter said.
Reid said Rudman, who was Jewish, learned to be tough at an early age battling bigots, but added "his rough exterior belied such a soft manner."
"When I think of him, the word irrepressible comes to mind," said Sen. Daniel Inouye, D-Hawaii.
